Re: Defamation of Oscar De La Hoya and Golden Boy Promotions

As you know, at yesterday’s press conference your client, Canelo Alvarez, falsely accused my client, Oscar De La Hoya, of stealing from boxers. He said this outrageous lie not once, but several times — both in English and Spanish and it has now been republished to millions around the world.

You surely understand the legal implications of such blatantly false allegations. It’s defamatory per se to accuse someone of a crime. Cal. Civ. Code §46(1). It’s also defamatory per se to make false statements specifically designed to injure someone’s business. Cal. Civ. Code §46(3). Canelo did both of those things yesterday. He falsely accused Oscar of a crime with the specific intention of supposedly warning other boxers not to do business with Oscar or Golden Boy. Clearly, Canelo intentionally defamed Oscar and Golden Boy.

Canelo’s statements were also made with actual malice. Obviously, Canelo harbors great animosity and ill-will towards Oscar (repeatedly referring to him as a “fucking asshole” and even stooping to using a derogatory slur regarding gay people to try and insult Oscar). But Canelo also knows full well that neither Oscar nor Golden Boy ever stole anything from him or anyone else. In fact, Golden Boy has paid Canelo every penny he was entitled to receive from his fights with Golden Boy, and then some. And Canelo knows it. Indeed, Canelo knows that it was Oscar and Golden Boy who established Canelo’s current market value with the groundbreaking deals they negotiated for him. Although Canelo may be disappointed that his career has plateaued since he left Golden Boy, that disappointment does not justify making such outrageous defamatory statements.

Accordingly, we hereby demand that Canelo cease and desist from making any further false and preposterous allegations against Oscar and Golden Boy. We also demand that Canelo immediately retract his defamatory allegations that Oscar stole from boxers.

Oscar and Golden Boy reserve all rights to sue Canelo for the damages caused by these defamatory accusations, including punitive damages designed to ensure Canelo learns his lesson.

    • What Canelo said was true no doubt and I knew it before any of this even took place. Oscar has ZERO loyalty and he wanted Canelo to dump his long time trainer Reynoso which is about when all this garbage began.

      Oscar dumped trainer after trainer and as a promoter look out he’ll sign you then dump you and kick you to the curb when your not doing so well, look no further than Andrew Cancio!

      Oh yea and yes he used to love to wear fishnets and stilettos!!

    • In September, Alvarez and his team filed a lawsuit against DAZN and Golden Boy over the situation, seeking at least $280 million in damages based on what is still owed to him (plus lost sponsorship and gate revenue). They have since been attempting to establish Canelo as a free agent, where he’d be able to land big money for seemingly any fight.

  • I believe in freedom of speech and with Oscar being a public figure, anyone should be able to say anything about him without consequence. I don’t care what people say about or call me, because as far as I’m concerned they should have a right to, even ethnic slurs.

  • oscar did start it so he needs to be able to take it as he “dishes” it out. however, they both need to “grow up” and be better role models for other young fighters, kids, and their own sons and daughters. this and ryan’s situation hurt boxing too..

  • It won’t be the first or TWENTY-FIRST time that scum bag goes to court or is TAKEN to court.
    All the people in his own company left him for a REASON. Most of his boxers have left him… for a REASON.
    Once your reputation has been established as a sleazy, low character POS, after MULTIPLE court appearances, why pretend?
    My guess is that he is just trying to annoy Canelo before the fight

    • What’s sad is desperate fighters trying to make their niche in the boxing spotlight will schmooze up with Oscar in hopes they make it “big”. Oscar is in it for money and knows very well some up-and-coming fighters will fall for his fairy tales, false promises, and pseudo-dreams. Anyone with an average IQ knows very well Oscar clouds the sport with red tape and what-ifs all to make sure he makes a profit off anyone that signs his contracts.

  • Canelo is right: Oscar is a “fucking asshole.” Whether Oscar stole from him is another concern but he’s definitely right about the asshole bit.

  • I am curious and waiting for what Canelo and his lawyers will do.
    The same way Oscar and Golden Boy Promotion promoted Canelo and helped make him marketable.

    Top Rank did the same with Oscar, even to the point of Oscar calling Bob a father figure, and giving Bob his Olympic Gold medal, but when things soured Oscar wanted his Olympic Gold medal back.

  • While damaging someone’s reputation is a very serious issue, I’d say that if fighters don’t feel that Oscar stole from them, then they would come out and defend him.
    If you’re not guilty, then what do you have to worry about?

  • Well Canelo is not wrong. Oscar stole didn’t pay Canelo all the money that they had agreed. Canelo even went far as to place a lawsuit on Golden Boy Promotions for unpaid money. Canelo is only speaking from personal experience. They have mutual disagreement and hatred for each other. Oscar is just upset that his bread and butter left him and is afraid that Canelo will persuade fighters to leave his promotion. He’s shitty promoter.

  • This is outrageous! Canelo should apologize immediately for stating the obvious. Oscar has tried to, but could not, get out of that dress, pantyhose, and woman’s high heels—before all those pictures were taken!!!

  • Truth is the ultimate defense against defamation claims, so Canelo has nothing to worry about. I believe Canelo. DLH is thin-skinned. He initially criticized Canelo, then when Canelo fired back, Mr. fishnets starts crying and throws a fit. I don’t think Canelo warranted the criticism DLH threw at him. Just to classless, unprofessional, petty, and immature.

    • Shouldn’t Canelo need to substantiate his accusations against DLH? Shouldn’t anyone need to substantiate such accusations against anyone? Canelo, on camera broadcast to the entire world, said DLH steals money from his clients. Then proceeded to counsel DLH’s fighter in Spanish.

      • Exactly ETK19, it will be difficult for Canelo to prove Oscar steals money from fighters (even if that is the case).

      • He did accuse him on the airways for millions to see, increasing the possibility of GBP being financially damaged because of torturous interference on behalf of the defendant, Mr. Saul Alvarez. 4 contracts were soured because of Mr. Alvarez’s disparaging comments to my client, Oscar De la joya and his company GBP. We are not aware of potential future monetary damages my client will suffer. This is why we are seeking 125 million dollars your honor.

  • wow just hope Oscar doesnt pull Vergil Ortiz from the Eddie Hearn card when he is suppose to fight Tim Tszyu

    • If they are confident they will defeat Tim Tszyu, would it be best not to stop the fight? I would think Hearn and Tszyu would want to find a way to postpone that fight. I have not watched a lot of Vergil & Tim’s fights but seem that Tim will run into trouble trying to walk into Vergil the way he did to other fighters in the couple fights I saw him in.

  • Interesting that their cease & desist, and retract notice made no promise to refrain from suing him.

  • The law establishes clearly that any defamatory action against a person should be proven in order to avoid being sued. Saul Alvarez crossed the line guided by his hate against Oscar, and not only once but several times, so if he is a man and smart as well, Saul should publicly apologize to avoid further problems because the evidence is overwhelming.
